Terms of Service

These terms apply when you hire Ascend ("we," "us," "Ascend") for website design, development, marketing, or related services. By signing a proposal, paying an invoice, or otherwise engaging Ascend for work, you agree to the terms below.

Scope of work

Each project is defined by the proposal, quote, or written agreement provided before work begins. That document outlines what's included, timelines, and pricing. Work outside that scope, additional pages, features, or services not originally agreed to, may require a separate quote.

Payment

A deposit is typically required before work begins, with the balance due at project completion or per an agreed payment schedule.
Late payments may pause active work until resolved.
Ongoing services (maintenance, SEO, ad management) are billed on a recurring basis and can be canceled with notice as outlined in your agreement.

Revisions

Projects include a reasonable number of revision rounds as outlined in your proposal. Requests significantly beyond the original scope or repeated large-scale changes after approval may be billed separately.

Timelines

Estimated timelines depend on timely feedback, content, and materials from you. Delays in providing what's needed (copy, images, approvals) will shift the project timeline accordingly.

Ownership

Once a project is paid in full, you own the final website files and content created specifically for you. Ascend retains the right to showcase completed work in its own portfolio unless otherwise agreed in writing. Any third-party assets (stock photography, licensed fonts, plugins) remain subject to their original licensing terms.

Results and performance

For marketing services like SEO and paid ads, Ascend works to follow current best practices, but no specific ranking, traffic, or conversion outcome is guaranteed. Results depend on many factors outside our control, including competition, platform algorithm changes, and market conditions.

Cancellation

Either party may end an ongoing engagement with written notice as outlined in your specific agreement. Work completed up to that point is billable. Deposits for one-time projects are generally non-refundable once work has begun, given the time already committed.

Limitation of liability

Ascend isn't liable for indirect, incidental, or consequential damages related to the use of a website or marketing service we build or manage, including downtime, third-party service outages, or business losses.

Governing law

These terms are governed by the laws of the State of Florida.
